3. PRODUCTS & ORDERS

All EASTERLY products are made-to-order. This means:

• Production begins after your order is placed
• Orders cannot be cancelled once production has started
• Production typically takes 2-7 business days before shipping

3.2 Product Descriptions

We strive to provide accurate product descriptions, images, and sizing information. However, slight variations in color, fit, or appearance may occur due to:

• Screen settings and display calibration
• Fabric batches and dye lots
• Production processes

We are not liable for minor variations that do not affect the quality or functionality of the product.

3.3 Pricing

All prices are listed in NZD (New Zealand Dollars)unless otherwise stated. Prices are subject to change without notice. The price you pay is the price displayed at the time of purchase.

3.4 Order Acceptance

We reserve the right to refuse or cancel any order at our discretion, including but not limited to:

• Suspected fraudulent activity
• Pricing or product errors
• Unavailability of products
• Violation of these Terms & Conditions

If your order is cancelled, we will notify you and issue a full refund.

We accept payment via Shopify Payments and other payment methods displayed at checkout.

4.2 Payment Security

All payment transactions are processed securely through Shopify's payment gateway. We do not store your credit card information.

4.3 Payment Confirmation

Your order will be confirmed once payment is successfully processed. You will receive an order confirmation email at the email address provided during checkout.

4.4 Payment Disputes

If you dispute a payment or initiate a chargeback without first contacting us to resolve the issue, we reserve the right to:

• Suspend or terminate your account
• Refuse future orders
• Pursue recovery of costs associated with the dispute

5. SHIPPING & DELIVERY

5.1 Shipping Locations

We ship internationally to most countries, including New Zealand, Australia, USA, Canada, UK, and others. Shipping options and costs will be displayed at checkout.

5.2 Shipping Times

• Production time: 2-7 business days (made-to-order)
• Shipping time: Varies by destination (typically 3-21 business days for international orders)

Total delivery time = production time + shipping time.

Estimated delivery times are provided as a guide only and are not guaranteed.

5.3 Shipping Delays

We are not responsible for delays caused by:

• Customs processing
• Courier delays or errors
• Natural disasters, pandemics, or unforeseen events
• Incorrect or incomplete shipping addresses provided by the customer
• Public holidays or peak shipping periods

5.4 Customs & Import Duties

International customers may be subject to customs fees, import duties, or taxes imposed by their country. These fees are the responsibility of the customer and are not included in our product or shipping prices.

We recommend checking with your local customs office for more information before placing an order.

5.5 Incorrect Shipping Address

Please ensure your shipping address is correct before placing your order. We are not responsible for orders shipped to incorrect addresses provided by the customer.

If you need to update your shipping address, contact us immediately at hello@easterly.kiwi. Once your order has shipped, we cannot change the address.

5.6 Lost or Stolen Packages

If your package is marked as delivered but you have not received it:

1. Check with neighbors or building management
2. Contact the shipping carrier using your tracking number
3. Contact us at hello@easterly.kiwi and we will assist you

We are not responsible for packages lost or stolen after delivery confirmation by the carrier.

6. RETURNS & REFUNDS

Please refer to our Refund Policy for full details on returns, refunds, and exchanges.

In summary:

• We do not accept returns for change of mind (made-to-order products)
• We offer replacements or refunds for defective, damaged, misprinted, or incorrect items
• EU/UK customers have a 14-day cooling-off period (see Refund Policy)

LIMITATION OF LIABILITY

c) Assumption of Risk
By purchasing from EASTERLY, you acknowledge and accept the normal risks associated with wearing and caring for apparel, including but not limited to: fabric wear, color fading, shrinkage, and the need to follow care instructions.

d) Proper Use and Care
You agree to use our products as intended and to follow all care instructions provided. EASTERLY is not liable for damage, injury, or loss resulting from:

• Misuse, neglect, or failure to follow care instructions
• Exposure to extreme heat, open flames, or harsh chemicals
• Alterations or modifications made to the product after purchase
• Normal wear and tear
• Failure to supervise children around small parts, buttons, zippers, or other components that may pose a choking hazard

e) Third-Party Claims
You agree to indemnify and hold EASTERLY harmless from any third-party claims, damages, or expenses arising from your use of our products.

f) Product Quality
While we strive for excellence, minor variations in color, print placement, and fabric texture are inherent to made-to-order production and do not constitute a defect.

g) Dispute Resolution
Any dispute arising from your purchase must first be resolved through good-faith negotiation. If unresolved, disputes will be handled through binding mediation or arbitration in New Zealand, under New Zealand law.

h) Jurisdiction
All purchases and disputes are governed by the laws of New Zealand. By purchasing from EASTERLY, you consent to the exclusive jurisdiction of New Zealand courts.

i) Allergies and Sensitivities
If you have known allergies or skin sensitivities, you are responsible for reviewing product materials and care information before purchasing. EASTERLY is not liable for allergic reactions or sensitivities to fabrics, dyes, or printing materials.

j) Force Majeure
EASTERLY is not liable for delays or failure to fulfill orders due to events beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, civil unrest, strikes, supplier failures, shipping disruptions, or government restrictions.

k) Intellectual Property
All designs, logos, images, and content on this site are the exclusive property of EASTERLY and are protected by copyright and trademark law. Unauthorized use, reproduction, or distribution is prohibited and may result in legal action.

l) No Warranty
Products are sold "as is" to the fullest extent permitted by law. EASTERLY makes no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable consumer protection laws.

m) Severability
