Welcome to EASTERLY ("we," "us," "our"). By accessing or using our website (www.easterly.kiwi) and purchasing our products, you agree to be bound by these Terms & Conditions. Please read them carefully.

If you do not agree with these terms,  please do not use our website or purchase our products.

2. ABOUT EASTERLY

EASTERLY is a premium apparel brand based in New Zealand. Our products are made-to-order through third-party print-on-demand fulfillment partners and shipped internationally.

3. PRODUCTS & ORDERS

3.1 Made-to-Order Products

All EASTERLY products are made-to-order. This means:

  • Production begins after your order is placed
  • Orders cannot be cancelled once production has started
  • As a guide, allow 3–6 weeks from order to delivery, depending on your location and fulfillment center

3.2 Product Descriptions

We strive to provide accurate product descriptions, images, and sizing information. However, slight variations in color, fit, or appearance may occur due to:

  • Screen settings and display calibration
  • Fabric batches and dye lots
  • Production processes

We are not liable for minor variations that do not affect the quality or functionality of the product.

3.3 Pricing

All prices are listed in NZD (New Zealand Dollars)unless otherwise stated. Prices are subject to change without notice. The price you pay is the price displayed at the time of purchase.

3.4 Order Acceptance

We reserve the right to refuse or cancel any order at our discretion, including but not limited to:

  • Suspected fraudulent activity
  • Pricing or product errors
  • Unavailability of products
  • Violation of these Terms & Conditions

If your order is cancelled, we will notify you and issue a full refund.

4. PAYMENT

4.1 Payment Methods

We accept payment via Shopify Payments and other payment methods displayed at checkout.

4.2 Payment Security

All payment transactions are processed securely through Shopify's payment gateway. We do not store your credit card information.

4.3 Payment Confirmation

Your order will be confirmed once payment is successfully processed. You will receive an order confirmation email at the email address provided during checkout.

4.4 Payment Disputes

If you dispute a payment or initiate a chargeback without first contacting us to resolve the issue, we reserve the right to:

  • Suspend or terminate your account
  • Refuse future orders
  • Pursue recovery of costs associated with the dispute

5. SHIPPING & DELIVERY

5.1 Shipping Locations

We ship internationally to most countries, including New Zealand, Australia, USA, Canada, UK, and others. Shipping options and costs will be displayed at checkout.

5.2 Shipping Times

  • As a guide, allow 3–6 weeks from order to delivery, depending on your location and fulfillment center. Please refer to our Shipping Policy for full details.

Estimated delivery times are provided as a guide only and are not guaranteed.

5.3 Shipping Delays

We are not responsible for delays caused by:

  • Customs processing
  • Courier delays or errors
  • Natural disasters, pandemics, or unforeseen events
  • Incorrect or incomplete shipping addresses provided by the customer
  • Public holidays or peak shipping periods

5.4 Customs & Import Duties

International customers may be subject to customs fees, import duties, or taxes imposed by their country. These fees are the responsibility of the customer and are not included in our product or shipping prices.

We recommend checking with your local customs office for more information before placing an order.

5.5 Incorrect Shipping Address

Please ensure your shipping address is correct before placing your order. We are not responsible for orders shipped to incorrect addresses provided by the customer.

If you need to update your shipping address, contact us immediately at hello@easterly.kiwi. Once your order has shipped, we cannot change the address.

5.6 Lost or Stolen Packages

If your package is marked as delivered but you have not received it:

  1. Check with neighbors or building management
  2. Contact the shipping carrier using your tracking number
  3. Contact us at hello@easterly.kiwi and we will assist you

We are not responsible for packages lost or stolen after delivery confirmation by the carrier.

6. RETURNS & REFUNDS

Please refer to our Refund Policy for full details on returns, refunds, and exchanges.

In summary:

  • We do not accept returns for change of mind (made-to-order products)
  • We offer replacements or refunds for defective, damaged, misprinted, or incorrect items
  • EU/UK customers have a 14-day cooling-off period (see Refund Policy)

7.1 Ownership

All content on www.easterly.kiwi, including but not limited to:

  • Logos, designs, and graphics
  • Text, images, and photography
  • Product designs and artwork
  • Website layout and structure

...is the property of EASTERLY and is protected by copyright, trademark, and other intellectual property laws.

7.2 Restrictions

You may not:

  • Reproduce, distribute, or use any content from our website without our prior written consent
  • Use our logos, designs, or branding for commercial purposes
  • Reverse engineer, copy, or replicate our product designs

Unauthorized use may result in legal action.
